1. Scope and role of ShareSpace
ShareSpace is a digital platform connecting users who OFFER and SEEK permitted spaces, goods, equipment, services or other categories.
Unless a specific flow expressly states otherwise, the contract relating to a listing is entered into between the users involved. ShareSpace facilitates search, contact, matching, booking, documentation, communication and, where provided, payment.
Providing the platform alone does not make ShareSpace the owner, landlord, custodian or provider of the listed subject.
2. Accounts and accurate information
Users must provide accurate, current and non-misleading information, protect credentials and prevent unauthorised use of their account.
Anyone acting for a business or another person must have the necessary authority.
Fake accounts, identity misuse, fraud, payment manipulation, circumvention of security measures and illegal activity may result in restrictions, suspension or blocking.
3. OFFER and SEEK listings
An OFFER user must have the right to provide the space, item or service and accurately state characteristics, price, availability, limits and conditions.
A SEEK user must truthfully describe the need and use what is obtained only for lawful and agreed purposes.
The parties remain responsible for ownership, permits, property/lease rules, safety, insurance, tax and any other applicable requirements. Anyone offering tools, machinery or other goods must disclose known defects or hazards and, where applicable, provide necessary warnings and safety instructions.
4. Matching, requests and bookings
A match or request does not automatically create a final contract. The agreement becomes binding at the point stated in the applicable acceptance, confirmation and, where relevant, signing flow.
Before confirmation, essential transaction information should be reviewable and input errors should be correctable within the available flow.
Where Swiss e-commerce rules apply, the flow must clearly identify the technical steps leading to contract conclusion, make legally required identity and contact details accessible and send an electronic confirmation of the transaction.
5. Contract and OTP electronic signing
Where provided, ShareSpace generates a contract from data confirmed by the parties. Signed versions are archived and must not be overwritten by later changes.
OTP, timestamp and audit trail are used to document electronic consent to a specific contract version.
The standard ShareSpace OTP process is not presented as a qualified electronic signature. If the law requires written form or a qualified signature for a specific act, the legally required form must be used.
6. Prices, abonnements, taxes and costs
Before confirmation, the available flow displays applicable amounts including the price/fee between the parties, the ShareSpace plan price, any deposit and other costs. For B2C offers subject to the Swiss Price Indication Ordinance, the total amount actually payable in CHF, including applicable non-optional surcharges, must also be clearly displayed.
ShareSpace does not retain any percentage from a sale, rental or other transaction between users. The only amount payable to ShareSpace is the price of the chosen plan under the terms shown on the Subscriptions page.
Each user remains responsible for their own taxes, reporting and declaration obligations.
7. Payments and payment provider
Payments for sales, rentals or other services between users are made directly between the parties using their agreed method; ShareSpace does not collect or transfer those amounts and does not act as an escrow service.
An external provider such as SumUp may be used to pay ShareSpace plans. Its terms apply to the subscription payment; ShareSpace does not receive or store full card numbers.
ShareSpace may record confirmations or declarative information useful to the contract, but it does not guarantee or certify a payment made directly between the parties.
8. Deposits
Where a deposit applies, its amount and purpose must be shown before confirmation together with release, possible retention and dispute rules.
A ShareSpace deposit is not a bank deposit or regulated escrow service unless such a structure is expressly implemented and stated.
9. Cancellation, termination and refunds
Applicable rules depend on contract type, category, duration, timing and the conditions accepted before confirmation.
For signed contracts, ShareSpace may provide a termination-request flow including reason, possible agreement, fee/penalty calculation, database record and closure document.
Swiss law does not provide a general withdrawal right for every contract concluded online. Any mandatory rights applicable to the specific case remain unaffected.
The Cancellations and refunds page forms part of these Terms.
10. Handover and return
Where available, the parties may use handover/return reports with notes, photographs and confirmations to document condition.
Uploaded content must relate to the contractual relationship and respect third-party privacy.
11. Chat, notifications and communications
Chat and notifications must be used lawfully and for relevant ShareSpace activities. Threats, harassment, phishing, spam, fraud and illegal content are prohibited.
System communications may concern requests, bookings, contracts, signatures, payments, terminations, refunds, safety and other operations needed to manage the relationship.
12. Reviews and user content
Reviews must reflect genuine experiences, be relevant and must not contain threats, unnecessary personal data, manipulated or unlawful content.
Anyone posting text, photographs or other content must hold the necessary rights and remains responsible for that content.
13. Safety and prohibited activity
Prohibited activity includes fraud, phishing, false identities, stolen/counterfeit goods, illegal substances, unlawfully offered weapons, undisclosed hazards, harassment, threats, exploitation and animal cruelty.
The Safety page contains additional rules and forms part of these Terms.
14. Privacy and personal data
Personal-data processing is described in the ShareSpace Privacy Policy. Identity documents, financial data, private addresses or sensitive third-party data must not be posted without a valid basis.
Data and documents may be retained where needed for contract, safety, evidence, support, accounting or legal obligations.
15. Moderation, suspension and blocking
ShareSpace may review, suspend, reject or remove listings and may restrict, suspend or block accounts where it identifies violations, fraud, risk, abuse, authority requests or platform-protection needs.
Material administrative actions may be recorded in an audit log and, where appropriate, communicated to the user.
16. Disputes
The parties should provide relevant information and evidence through available tools. ShareSpace may facilitate an administrative review but does not replace a court, authority or arbitration service.
Payments, deposits, refunds or other operations may be temporarily paused only where technically and contractually provided.
17. Liability
Each user is responsible for their statements, the offered/sought subject, its lawfulness and performance of the contract with the other party.
To the extent permitted by law, ShareSpace is not liable for false user information, non-performance between users, events outside its control or use contrary to these Terms.
Liability that cannot legally be excluded or limited remains unaffected.
18. Governing law, venue and changes
The relationship with the ShareSpace operator is governed by Swiss law, subject to mandatory rights and venues.
ShareSpace may update these Terms when features, procedures or legal requirements change. Material changes are communicated appropriately and renewed acceptance is obtained where required.
